Terms of Service
These Terms of Service ("Terms") govern your use of the tax preparation and filing services provided by NextGen Taxes ("NextGen," "we," "us," or "our"), operated by NextGen Taxes, a partnership registered in Alberta. By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use the service.
1. Our service
NextGen provides fully digital personal income tax preparation and filing, pairing you with a human tax specialist who prepares, reviews, and files your Canadian income tax return. Our specialists prepare returns based on the information and documents you provide.
2. Eligibility
To use our service you must be a Canadian resident for tax purposes and 18 or older. If you are under 18 — which is common for students filing a first return — we are glad to help, but we need a parent or legal guardian to agree to these Terms on your behalf.
3. How the service works
You complete a short intake form; a dedicated specialist contacts you within one business day on your chosen channel; you upload your documents through a secure portal; your specialist prepares your return and reviews it with you; and your return is filed only after you approve it.
4. Pricing and payment
The price shown by our pricing estimator is your price, provided the situation you selected matches your documents. Your specialist verifies your documents against your selections. If your documents reveal additional complexity that changes the price, we will tell you the revised amount and the reason before any further work is done, and you decide whether to proceed. Applicable sales taxes are additional. You pay only after you approve your completed return and before it is filed.
One exception, stated plainly: if your records arrive unorganized enough that we need to do bookkeeping before a return can be prepared, that is work beyond tax preparation and may carry a one-time additional fee. We will tell you the amount and the reason first, and you decide whether to go ahead. We will never add a fee you have not agreed to.
5. Your responsibilities
You are responsible for providing complete, accurate, and truthful information and documents. The accuracy of your return depends on the information you provide. You are responsible for reviewing your completed return before approving it, and you remain ultimately responsible for the contents of the return filed on your behalf.
6. No guarantee of outcome
We work to prepare an accurate return and to claim the credits and deductions you are eligible for, but we do not and cannot guarantee any particular refund amount, tax result, or outcome. Final assessments are determined by the Canada Revenue Agency.
7. Cancellation and refunds
You are never charged for a return you have not approved. You can stop at any point before you approve your completed return and pay — just tell your specialist — and you will owe us nothing. There is no cancellation fee and no obligation to continue.
Once you have approved your return, paid, and we have filed it, the work is complete and the fee is not refundable. If we have made an error, that is a different matter: tell us and we will correct it and refile at our own cost.
8. Privacy and confidentiality
We handle your personal information in accordance with our Privacy Policy. Your documents are accessible only to you and your assigned specialist and are stored in Canada.
9. Third-party services
Our service relies on third-party providers, including our intake platform, tax-preparation platform, payment processor, and communications tools, as well as filing with the Canada Revenue Agency. Your use of those services may also be subject to their terms.
10. Intellectual property
All content on this website, including text, graphics, logos, and the "Nailed it!" mark, is the property of NextGen Taxes or its licensors and may not be used without permission.
11. Disclaimers and limitation of liability
We provide our service with reasonable skill and care, but we do not promise that it will be uninterrupted or error-free, and we do not guarantee any particular tax outcome.
To the fullest extent permitted by law, our total liability to you for any claim connected to our service is limited to the amount you paid us for the return in question. We are not liable for indirect or consequential losses — for example lost income, lost opportunity, or interest and penalties arising from information you did not give us or gave us incorrectly.
Nothing in these Terms limits any right you have under applicable consumer protection legislation, and nothing here excludes liability for our own gross negligence, wilful misconduct, or fraud. If you believe we have made an error, contact us first — we would rather fix it than argue about it.
12. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, and the courts of Alberta have jurisdiction over any dispute. This does not affect any right you may have to bring a claim where you live.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted here with a revised "Last updated" date. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
